If you purchase a Lifetime Subscription, the following additional terms apply:
1. **No Refunds:** No refunds will be provided if the application stops functioning, becomes unavailable, or is discontinued.
2. **Access Duration:** The Lifetime Subscription grants you access to the application's services and features for as long as the application remains available and operational.
3. **Service Availability:** While we strive to maintain continuous service, we do not guarantee uninterrupted access. The application may become temporarily or permanently unavailable due to maintenance, technical issues, or other reasons.
4. **Modifications:** DiscoverApp reserves the right to modify, update, or discontinue the application at any time without prior notice. If the application is discontinued, your Lifetime Subscription will no longer be valid.
5. **Non-Transferable:** The Lifetime Subscription is non-transferable and can only be used by the original purchaser. It cannot be resold, shared, or transferred to any other person or entity.
6. **Account Security:** You are responsible for maintaining the security of your account credentials. DiscoverApp is not liable for unauthorized access to your account.
7. **Termination:** Misuse or violation of these Terms may result in termination of your Lifetime Subscription without refund or compensation.

## EXPORT CONTROL

5. **Product Claims:** DiscoverApp, not Apple, is responsible for addressing any claims by you or any third party relating to the application or your possession and use of the application, including:
- Product liability claims
- Claims that the application fails to conform to legal or regulatory requirements
- Claims arising under consumer protection or similar legislation
6. **Intellectual Property Rights:** In the event of any third-party claim that the application infringes that third party's intellectual property rights, DiscoverApp, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
7. **Legal Compliance:** You must comply with applicable third-party terms when using the application (e.g., your wireless data service agreement).
8. **Third-Party Beneficiary:** Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

### Class Action Waiver
YOU AND DISCOVERAPP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Notwithstanding the above, either party may bring a claim in small claims court if it qualifies for small claims court jurisdiction.

DiscoverApp shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

As used in these Terms:
- "Including" means "including but not limited to"
- Headings are for convenience only and do not affect interpretation
- The singular includes the plural and vice versa
